Legionella is a bacterium that can kill large numbers of people by causing Legionnaires Disease, a form of water-borne pneumonia. Hot and cold-water systems in healthcare and dental practices are at high risk from this infection. Your practice must also be up to date with Control of Substances Hazardous to Health (COSHH) regulations.

Legionella and COSHH and the Law

Legionella risks are covered by the Health and Safety at Work etc Act 1974 and by the COSHH Regulations of 2002.

COSHH breaches are crimes that can be punished with unlimited fines.

There is an Approved Code of Practice: Legionnaires’ disease: The control of Legionella bacteria in water systems (L8) that gives the best advice on controlling these risks.

The HTM 04-01 also gives guidance on the legal requirements, design applications, maintenance and operation of hot and cold-water supply, storage and distribution systems in all types of healthcare premises.

The HTM 04-01 comes in separate 'parts' and should be read in conjunction with the HSE’s Approved Code of Practice (L8)

As with most health and safety legislation, there is a responsibility to identify, manage, prevent, and control risks, and to demonstrate that you have done so with COSHH regulations. Your risk assessment must include records of training to prevent legionella infection.

Training and Compliance

Risk assessments and control measures for hazardous substances and legionella are looked for in practice inspections carried out by the Care Quality Commission (in Wales, the Healthcare Inspectorate Wales).
