Information Governance and GDPR: Your Duties and the Law

The duty to provide safe and appropriate care to patients is an overarching one in healthcare legislation and regulation. Privacy and information governance can impact on these responsibilities.

The Care Quality Commission (CQC), and in Wales, the Healthcare Inspectorate Wales, publish general guidance on data protection duties, which are enforced by the Information Commissioners Office (ICO). There are further standards set by the National Data Guardian in the NHS and the Information Governance Alliance.

The EU’s General Data Protection Regulation has been in force in the UK since May 2018. The Data Protection Act 2018 is expected to enforce an equivalent regime, post Brexit.

The GDPR is a wide-ranging and comprehensive set of rules around the collection, storage, and processing of personal data. All organisations that collect personal data must comply with it. It includes an overarching set of data protection principles that include hiding personal identifying details, getting informed consent for any data collection, the disclosure of any data collection.

Article 8 of the Human Rights Act is the “right to respect for your family and private life,” including the right to know how your personal information is protected and stored.

Information about health is considered a category of sensitive information in data protection legislation, and must be stored with extra care.

Any organisations with access to patient data and systems should use the NHS’s own data Security and Protection Toolkit (DSPT).
