Mental Capacity and Dementia: The Law and Your Responsibilities
The rights of people who cannot make all decisions for themselves are protected by the Mental Capacity Act (2005). The Mental Capacity Act Code of Practice introduces the guidance to healthcare professionals and advises what is expected of them.
Guidelines from the National Institute for Healthcare Excellence also gives specific mental capacity guidance for health and social care practitioners. This includes advice on how to support people to make the decisions (the overriding assumption of the Act); to keep patients involved in decisions they cannot make fully on their own, and how to make decisions in a patient’s best interest.
The Care Quality Commission (in Wales, Healthcare Inspectorate Wales) inspects healthcare providers. The five questions – Key Lines of Enquiry (KLOEs), which CQC inspections are based on, include asking whether services and staff are Safe, Effective, Caring, Responsive and Well-led.
In its enhanced CPD scheme, the GDC recommends regular training in: Legal and ethical issues and safeguarding, including safeguarding for vulnerable adults.
The GDC has also published Standards for the Dental Team, which includes standards that help protect patients who may not be able to make all decisions about their care themselves. This includes assessing the ability of patients to make decisions; providing appropriate patient care in a holistic way that takes account of all of a patient’s needs; and providing treatment that is in a patient’s best interests.
